The Levens Bridge to Carlisle Trunk Road (A595 Egremont Bypass) (Detrunking) Order 1989

The Secretary of State for Transport makes this order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:-

1.  The length of trunk road described in the Schedule to this order and shown by broad striped hatching on the deposited plan shall cease to be a trunk road and shall be classified as a classified road as from the date on which the Secretary of State notifies the County Council of Cumbria that the new trunk road is open for through traffic.

2.  In this order:

(1) the measurement of distance is measured along the route of the relevant highway;

(2) (i) “the deposited plan” means the plan numbered HA1O/1 CNW 256 marked “The Levens Bridge to Carlisle Trunk Road (A595 Egremont Bypass) (Detrunking) Order 1989” signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

(ii)“the trunk road” means the (A595) Levens Bridge to Carlisle Trunk Road;

(iii)“the new trunk road” means the new trunk road to be constructed by the Secretary of State in pursuance of the Levens Bridge to Carlisle Trunk Road (A595 Egremont Bypass) Order 1989.

(iv)“classified road” as a classification for a highway means that the highway is not a principal road for the purpose of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads.

3.  This Order shall come into force on 25th August 1989 and may be cited as the Levens Bridge to Carlisle Trunk Road (A595 Egremont Bypass) (Detrunking) Order 1989.

THE SCHEDULELENGTH OF TRUNK ROAD CEASING TO BE A TRUNK ROAD

That length of the trunk road at Egremont in the County of Cumbria approximately 2.97 kilometres in length starting at a point approximately 225 metres south of its junction with Gillfoot Road to a point approximately 44 metres south of its junction with Ehen Road, Thornhill.
