THE NURSES, MIDWIVES AND HEALTH VISITORS ACT 1979

The United Kingdom Central Council for Nursing, Midwifery and Health Visiting, in exercise of the powers conferred on it by sections 2(3), 10(3), 11 and 22(1) of the Nurses, Midwives and Health Visitors Act 1979 and all other powers enabling it in that behalf having, in accordance with section 22(3) of the Act, consulted the National Boards and representatives of groups likely to be affected by these Rules, hereby makes the following Rules:

Citation and Interpretation

1.(1) These Rules may be cited as the Nurses, Midwives and Health Visitors (Registered Fever Nurses) Amendment Rules 1989.

(2) In these Rules “the principal Rules” means the Nurses, Midwives and Health Visitors Rules 1983(1).

(3) Any reference in these Rules to a Part of the register is a reference to the Part determined in accordance with the Nurses, Midwives and Health Visitors (Parts of the Register) Order 1983(2).

Amendment of the principal Rules

2.(1) The principal Rules shall be amended in accordance with the following paragraph of this Rule.

(2) In Rule 6 (admission to Part or Parts of the register following the successful completion of an approved course of training in the United Kingdom)–

(a)in paragraph (1) for the words “and 1(B)” there shall be substituted the words “, 1(B) and 1(C)”; and

(b)after paragraph 1(B) insert:–

1(C)  Any person who has made an application in writing to be admitted to Part 9 of the register and who–

(a)has before 1st July 1983 trained and passed the examination in the nursing of persons suffering from fever; and

(b)is not registered in, and cannot be admitted to, any other Part of the register; and

(c)has furnished evidence to satisfy the Council that she has completed successfully the training and examination; and

(d)has, where the Council so requires, paid the registration fee; and

(e)has satisfied the Council that she is of good character;

shall be admitted to Part 9 of the register..

THE NURSES, MIDWIVES AND HEALTH VISITORS ACT 1979

The United Kingdom Central Council for Nursing, Midwifery and Health Visiting in exercise of the powers conferred on it by Sections of the Nurses, Midwives and Health Visitors Act 1979(3), namely:–

and all other powers enabling it in that behalf having, in accordance with Section 22(3) of the Act, consulted the National Boards and representatives of groups likely to be affected by these Rules, hereby makes the following Rules:–

Citation and interpretation

1.(1) These Rules may be cited as the Nurses, Midwives and Health Visitors (Training) Amendment Rules 1989.

(2) In these Rules “the principal Rules” means the Nurses, Midwives and Health Visitors Rules 1983(4).

Amendment of the principal Rules

2.(1) The principal Rules shall be amended in accordance with the following paragraphs of this Rule.

(2) In Rule 2(1) of the principal Rules–

(a)before the definition of “approved training institution” there shall be inserted the following definition:–

“approved educational institution” means an institution or part of an institution or a combination of institutions approved by a National Board under Section 6 of the Act for the purposes of these Rules as an institution or as part of an institution or institutions providing a course of preparation;;

(b)the definition of “approved training institution” shall be amended to delete “a Part or Parts of the register” and substitute “any of Parts 1 to 8 and 10 and 11 of the register”;

(c)after the definition of “the Council” there shall be inserted the following definition:–

“course of preparation” means a course which meets the requirements of the Council as to its content and standard, the successful completion of which enables an application to be made for admission to Part 12, 13, 14 or 15 of the register.;

(d)the definition of “educational establishment” shall be amended to insert “or approved educational institution” after “approved training institution”.

(3) In Rule 6(1) of the principal Rules sub-paragraph (c) shall be amended by adding “or approved educational institution” after “approved training institution”.

(4) Paragraph (1) of Rule 8 of the principal Rules shall be amended by deleting “10 or 11” and substituting “10, 11, 12, 13, 14 or 15”.

(5) Rule 13 of the principal Rules shall be amended by inserting “and 12 to 15” after “Parts 1–8”.

(6) After Rule 14 the following new Rule shall be inserted:–

Nursing Education leading to a Registration in Parts 12, 13, 14 or 15 of the Register

14A.(1) A person intending to apply for admission to any of Parts 12, 13, 14 or 15 of the register shall take a course of preparation in accordance with the following provisions of this Rule.

(2) Subject to paragraphs (8) and (9) of this Rule, a course of preparation shall not be less than three years in length and each year shall contain 45 programmed weeks.

(3) A course of preparation shall comply with the requirements of Rule 18A of these Rules.

(4) The course of preparation shall consist of:–

(a)a Common Foundation Programme; and

(b)a Branch Programme which shall be in the branch of nursing specified in paragraph (7) of this Rule as being appropriate for the Part of the register to which admission is to be sought.

(5) Subject to paragraphs (8) and (9) of this Rule all students shall undertake the Common Foundation Programme which shall be not less than eighteen months in length.

(6) Subject to paragraphs (8) and (9) of this Rule the Common Foundation Programme shall be followed by the Branch Programme, students being required to undertake preparation in one branch for not less than eighteen months.

(7) The Branch Programme shall consist of one of the following four branches:–

(a)Adult Nursing, where admission is to be sought to Part 12 of the register;

(b)Mental Health Nursing, where admission is to be sought to Part 13 of the register;

(c)Mental Handicap Nursing, where admission is to be sought to Part 14 of the register;

(d)Children’s Nursing, where admission is to be sought to Part 15 of the register.

(8) The duration of a course of preparation shall be varied in the following cases:–

(a)where the student is already registered in any of Parts 1, 3, 5, 8, 12, 13, 14, or 15 of the register, it shall be not less than one year, the whole of which period shall be spent on the appropriate Branch Programme;

(b)where the student is already registered in any of Parts 2, 4, 6 and 7 of the register, it shall be not less than eighteen months, the whole of which period shall be spent on the appropriate Branch Programme;

(c)where the student either–

(i)holds a degree awarded following a course approved by the Council on the recommendation of a Board, or

(ii)is already registered in Part 10 of the register but not registered in Part 1 of the register,

it shall be not less than two years, of which not less than six months shall be spent on the Common Foundation Programme followed by not less than eighteen months on the appropriate Branch Programme.

(9) Where, in the case of any student or category of students, the Council is satisfied on the recommendation of a Board that the course of preparation could be completed within a lesser period than that specified in any of paragraphs (2), (5) and (6) or in any of sub-paragraphs (a) to (c) of paragraph (8) of this Rule, those paragraphs shall, in relation to that student or category of students, have effect as if, for any period there specified, there were substituted such lesser period as the Council may require.

(10) The content of a course of preparation shall include a period of practical experience of nursing of such duration as the Council may from time to time require in relation to any particular approved educational institution.

(11) A student undertaking a course of preparation to which this Rule applies–

(a)shall be directed throughout the course of preparation by the approved educational institution; and

(b)shall have supernumerary status.

(12) A course of preparation leading to a qualification the successful completion of which shall enable an application to be made for admission to Part 12 of the register shall meet the requirement of the Nursing Directive.

(13) In this Rule–

(a)“Nursing Directive” means Council Directive No. 77/453/EEC concerning the co-ordination of provisions laid down by law, regulation or administrative action in respect of the activities of nurses responsible for general care(5);

(b)“supernumerary status” means, in relation to a student, that she shall not as part of her course of preparation be employed by any person or body under a contract of service to provide nursing care..

(7) Rule 15 shall be amended to add the words “or an approved educational institution” after the words “approved training institution”.

(8) In Rule 16 of the principal Rules–

(a)paragraph (1) shall be amended by deleting “5 or 8” and substituting “5, 8, 12, 13, 14 or 15,”;

(b)for sub-paragraphs (a), (b) and (c) of paragraph (1) of the principal Rules there shall be substituted the following sub-paragraphs:–

(a)a minimum of five subjects any of which may be obtained in the General Certificate of Secondary Education in England and Wales grade A, B or C, or at Ordinary level grade A, B or C in the General Certificate of Education of England and Wales, or at Grade 1 in the Certificate of Secondary Education; or

(b)a minimum of five subjects any of which may be obtained at Ordinary or Standard Grade, grade 1, 2 or 3, or at Ordinary Grade (band A, B or C) in the Scottish Certificate of Education; or

(c)a minimum of five subjects any of which may be obtained in the General Certificate of Secondary Education in Northern Ireland, grade A, B or C, or at grade A, B or C in the Northern Ireland General Certificate of Education at Ordinary level, or passes in the examination for the Northern Ireland Grammar School Senior Certificate of Education; or.

(9) In Rule 17 of the principal Rules–

(a)after paragraph (1) there shall be inserted the following paragraph:–

(1A) A student having an interruption in a course of preparation of:–

(a)less than three years, shall complete the outstanding period of the course of preparation;

(b)three years or more, shall complete the outstanding period of the course of preparation and such additional preparation as the appropriate National Board may determine.;

(b)paragraph (3) shall be amended to add “or approved educational institution” after the words “approved training institution”.

(10) In Rule 18 of the principal Rules–

(a)paragraph (2) shall be amended by deleting “5 or 8” and substituting “5, 8, 12, 13, 14 or 15”;

(b)sub-paragraph (b) of paragraph (2) shall be amended by deleting “5 or 8” and substituting “5, 8, 12, 13, 14 or 15”.

(11) After Rule 18 of the principal Rules the following Rule shall be inserted:–

Preparation for entry to Parts 12, 13, 14 and 15 of the register

18A.(1) The content of the Common Foundation Programme and the Branch Programme shall be such as the Council may from time to time require.

(2) The Common Foundation Programme and the Branch Programme, shall be designed to prepare the student to assume the responsibilities and accountability that registration confers, and to prepare the nursing student to apply knowledge and skills to meet the nursing needs of individuals and of groups in health and in sickness in the area of practice of the Branch Programme and shall include enabling the student to achieve the following outcomes:–

(a)the identification of the social and health implications of pregnancy and child bearing, physical and mental handicap, disease, disability, or ageing for the individual, her or his friends, family and community;

(b)the recognition of common factors which contribute to, and those which adversely affect, physical, mental and social well-being of patients and clients and take appropriate action;

(c)the use of relevant literature and research to inform the practice of nursing;

(d)the appreciation of the influence of social, political and cultural factors in relation to health care;

(e)an understanding of the requirements of legislation relevant to the practice of nursing;

(f)the use of appropriate communication skills to enable the development of helpful caring relationships with patients and clients and their families and friends, and to initiate and conduct therapeutic relationships with patients and clients;

(g)the identification of health related learning needs of patients and clients, families and friends and to participate in health promotion;

(h)an understanding of the ethics of health care and of the nursing profession and the responsibilities which these impose on the nurse’s professional practice;

(i)the identification of the needs of patients and clients to enable them to progress from varying degrees of dependence to maximum independence, or to a peaceful death;

(j)the identification of physical, psychological, social and spiritual needs of the patient or client; an awareness of values and concepts of individual care; the ability to devise a plan of care, contribute to its implementation and evaluation; and the demonstration of the application of the principles of a problem-solving approach to the practice of nursing;

(k)the ability to function effectively in a team and participate in a multi-professional approach to the care of patients and clients;

(l)the use of the appropriate channel of referral for matters not within her sphere of competence;

(m)the assignment of appropriate duties to others and the supervision, teaching and monitoring of assigned duties..

(12) In Rule 19 of the principal Rules–

(a)paragraph (1) shall be amended to insert “and 12 to 15” after “Parts 1 to 8”;

(b)sub-paragraph (b) of paragraph (1) shall be amended to insert “, 14A” after “14”;

(c)sub-paragraph (c) of paragraph (1) shall be amended to insert “or to achieve the relevant outcomes specified in Rule 18A(2)” after “18”;

(d)at the beginning of paragraph (2) the words “Subject to paragraph (2A) of this Rule,” shall be inserted;

(e)after paragraph (2) there shall be inserted the following paragraphs:–

(2A) Where a person–

(a)was either:–

(i)before the 1st July 1983 admitted to a register or roll mentioned in any of paragraphs (2), (5) and (8) in Column 1 of Schedule 2 to the Nurses, Midwives and Health Visitors (Parts of the Register) Order 1983(6);

or

(ii)since 1st July 1983 admitted to any of Parts 2, 4, 6 or 7 of the register; and

(b)attempted, on the maximum number of occasions permitted by rules referred to in paragraph (2) of this Rule, any examination or section of an examination the successful completion of which would have rendered her eligible for inclusion in a register mentioned in any of paragraphs (1), (4) and (7) in Column 1 of that Schedule; and

(c)on each such occasion failed to pass that examination or section of an examination, that person may, on no more than three occasions, enter for an examination or section of an examination the successful completion of which will, subject to her compliance with Rules 6 and 14 of these Rules, enable her to apply for entry to that Part of the register in which she would have been registered pursuant to Article 4(1) of that Order if she had been successful in obtaining entry to a register mentioned in any of paragraphs (1), (4) and (7) in Column 1 of that Schedule.

(2B) Subject to paragraph (2C) of this Rule, where a person has failed on the maximum number of occasions permitted by these Rules to pass an examination or section of an examination leading to a qualification enabling that person to apply for admission to any of Parts 1, 3, 5 and 8 of the register she may not enter for that examination or section of an examination again.

(2C) Where a person has been admitted to any of Parts 2, 4, 6 and 7 of the register and either before or after her admission to such Part of the register she has–

(a)completed training for a qualification the successful completion of which would have enabled her to apply for admission to any of Parts 1, 3, 5 and 8 of the register; and

(b)failed on the maximum number of occasions permitted by these Rules to pass the necessary examination or section of an examination,

she may on a further three occasions enter again for that examination or section of an examination the successful completion of which will, subject to her compliance with Rules 6 and 14 of these Rules, enable her to apply for entry to any of Parts 1, 3, 5 and 8 of the register..

(13) Rule 20 of the principal Rules shall be amended to insert the words “and an approved educational institution” after the words “approved training institution”.

(14) For heads (i), (ii) and (iii) of Rule 22(1)(c) of the principal Rules there shall be substituted the following heads:–

(i)a minimum of five subjects any of which may be obtained in the General Certificate of Secondary Education in England and Wales, grade A, B or C, or at Ordinary level grade A, B or C in the General Certificate of Education of England and Wales, or at Grade 1 in the Certificate of Secondary Education; or

(ii)a minimum of five subjects any of which may be obtained at Ordinary or Standard Grade, grade 1, 2 or 3, or at Ordinary Grade (band A, B or C) in the Scottish Certificate of Education; or

(iii)a minimum of five subjects any of which may be obtained in the General Certificate of Secondary Education in Northern Ireland, grade A, B or C, or at grade A, B or C in the Northern Ireland General Certificate of Education at Ordinary level, or passes in the examination for the Northern Ireland Grammar School Senior Certificate of Education; or.

(15) For sub-paragraphs (a), (b) and (c) of Rule 30(1) of the principal Rules there shall be substituted the following sub-paragraphs:–

(a)a minimum of five subjects any of which may be obtained in the General Certificate of Secondary Education in England and Wales, grade A, B or C, or at Ordinary level grade A, B or C in the General Certificate of Education of England and Wales, or at Grade 1 in the Certificate of Secondary Education, of which one shall be English Language and one shall be a Science subject; or

(b)a minimum of five subjects any of which may be obtained at Ordinary or Standard Grade, grade 1, 2 or 3, or at Ordinary Grade (band A, B or C) in the Scottish Certificate of Education, of which one shall be English and one shall be a Science subject; or

(c)a minimum of five subjects any of which may be obtained in the General Certificate of Secondary Education in Northern Ireland, grade A, B or C, or at grade A, B or C in the Northern Ireland General Certificate of Education at Ordinary level, of which one shall be English Language and one shall be a Science subject; or.
