The Welsh Water Authority (Abergele Chest Hospital Waterworks) Order 1989

The Secretary of State for Wales, on the application of the Welsh Water Authority, as statutory water undertakers(1), and in exercise of powers conferred by sections 23 and 59(1)(2) of the Water Act 1945(3) and now vested in him(4), and of all other powers enabling him in that behalf, hereby makes the following Order:–

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Welsh Water Authority (Abergele Chest Hospital Waterworks) Order 1989 and shall come into force on 31st August 1989.

(2) This Order and the Welsh Water Authority Orders 1976 to 1988 may be cited together as the Welsh Water Authority Orders 1976 to 1989.

(3) In this Order:–

“the Abergele Chest Hospital Waterworks” means the waterworks vested in the Secretary of State for Wales, as described in the Schedule to this Order;

“the Authority” means the Welsh Water Authority;

“the deposited plan” means the plan prepared in duplicate signed by an Assistant Secretary in the Welsh Office and marked“Plan referred to in the Welsh Water Authority (Abergele Chest Hospital Waterworks) Order 1989” of which one copy is deposited and available for inspection at the offices of the Authority at Cambrian Way, Brecon and the other at the Welsh Office, Cathays Park, Cardiff; and“the undertaking”, means the water undertaking of the Authority as for the time being authorised by any enactment.

Power to acquire, continue and maintain works

2.  The Authority may, by agreement with the Secretary of State for Wales, acquire the Abergele Chest Hospital Waterworks upon such terms and conditions as may be so agreed and may therefore continue and maintain the said waterworks.

Works to form part of the undertaking

3.  The Abergele Chest Hospital Waterworks when acquired by the Authority in pursuance of this Order shall for all purposes form part of the undertaking.

SCHEDULEDESCRIPTION OF THE ABERGELE CHEST HOSPITAL WATERWORKS

(a)

Land situated in the Community of Abergele in the Borough of Colwyn in the County of Clwyd being part of enclosure number 7634 on the 1/2500 Scale Ordnance Survey Map Sheet number SH 9476 Edition of 1961shown edged mauve on the deposited plan;

(b)

The service reservoir erected on land situate in the Community of Llanfair Talhaiarn in the said Borough being part of enclosure number 0006 on the 1/2500 Scale Ordnance Survey Map Sheet number SH 9475 Edition of 1961 shown edged mauve on the deposited plan;

(c)

The mains pipes and apparatus situated partly in the said Community of Abergele and partly in the said Community of Llanfair Talhaiarn the approximate lines and positions of which are shown by red lines on the deposited plan; and

(d)

All rights, powers, privileges, agreements exercisable by the Secretary of State in respect of the matters aforesaid.
