The Secretary of State for Transport (as respects England), the Secretary of State for Scotland (as respects Scotland) and the Secretary of State for Wales (as respects Wales), in exercise of the power conferred by section 93(7)(f) of the Transport Act 1985(1), and of all other enabling powers, hereby make the following Order:–

Citation, commencement and introduction

1.  This Order may be cited as the Transport Act 1985 (Extension of Eligibility for Travel Concessions) (Amendment) Order 1989 and shall come into force on 1st January 1990.

2.  The Transport Act 1985 (Extension of Eligibility for Travel Concessions) Order 1986(2) shall be amended in accordance with the following provisions of these Regulations.

Amendment of interpretation

3.  In article 2–

(a)for the words ““the 1972 Act” means the Road Traffic Act 1972;”(3) there shall be substituted the words “ “the 1988 Act” means the Road Traffic Act 1988”(4);

(b)in the definition of “driving licence” for the words “Part III of the 1972 Act” there shall be substituted the words “Part III of the 1988 Act”.

Amendment of eligible classes in England and Wales

4.  In article 3–

(a)for paragraph (1)(b) there shall be substituted–

(b)persons–

(i)to whom the Secretary of State has refused to grant driving licences pursuant to section 92 of the 1988 Act; or

(ii)whose driving licences have been revoked by the Secretary of State pursuant to section 93 of the 1988 Act;;

(b)after paragraph (1)(b) there shall be inserted the following sub-paragraph–

(bb)persons who in the opinion of the authority or any of the authorities responsible for administration of the travel concession scheme in question are the persons referred to in paragraph (1A);; and

(c)after paragraph (1) there shall be inserted the following paragraph–

(1A) The persons mentioned in paragraph (1)(bb) are persons who if they applied to the Secretary of State for the grant of a driving licence would be likely to be refused such a grant pursuant to section 92 of the 1988 Act..

Amendment of eligible classes in Scotland

5.  In article 4–

(a)for paragraph (1)(a) there shall be substituted–

(a)persons–

(i)to whom the Secretary of State has refused to grant driving licences pursuant to section 92 of the 1988 Act; or

(ii)whose driving licences have been revoked by the Secretary of State pursuant to section 93 of the 1988 Act;;

(b)after paragraph (1)(a) there shall be inserted the following sub-paragraph–

(aa)persons who in the opinion of the authority or any of the authorities responsible for administration of the travel concession scheme in question are the persons referred to in paragraph (1A);; and

(c)after paragraph (1) there shall be inserted the following paragraph–

(1A) The persons mentioned in paragraph (1)(aa) are persons who if they applied to the Secretary of State for the grant of a driving licence would be likely to be refused such a grant pursuant to section 92 of the 1988 Act..

Explanatory Note

(This note is not part of the Order)

This Order amends the Transport Act 1985 (Extension of Eligibility for Travel Concessions) Order 1986 so that a new class of persons is eligible to receive travel concessions under travel concession schemes in England (except London), Wales and Scotland. The class is persons who in the opinion of the authority or authorities responsible for administering such schemes are persons who if they applied to the Secretary of State for the grant of a driving licence would be likely to be refused such a grant pursuant to section 92 of the Road Traffic Act 1988.
