The City of Glasgow and Eastwood Districts (Muirend Road/Netherlee Road) Boundaries Amendment Order 1989

Whereas under section 17(1) of the Local Government (Scotland) Act 1973((1)) the Local Government Boundary Commission for Scotland on 9th August 1988 submitted to the Secretary of State a report on a review conducted under section 14(2) of that Act in which they made proposals for the transfer of certain areas between the City of Glasgow District and Eastwood District and in which they also made proposals for changes in electoral arrangements consequential on those changes in local government areas;

Now therefore, in exercise of the powers conferred on him by section 17(2) of the said Act, and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order to give effect to the proposals of the Local Government Boundary Commission for Scotland as submitted to him:

Title and commencement

1.  This Order may be cited as the City of Glasgow and Eastwood Districts (Muirend Road/Netherlee Road) Boundaries Amendment Order 1989, and shall come into force on 1st April 1989.

Interpretation

2.  In this Order—

“the 1977 Regulations” means the Local Government Area Changes (Scotland) Regulations 1977((2)); and

“boundary map” means the map prepared by the Scottish Office marked “The City of Glasgow and Eastwood Districts (Muirend Road/Netherlee Road) Boundaries Amendment Order 1989 Map” and deposited in accordance with regulation 3 of the 1977 Regulations;

and, in the Schedule to this Order, any reference to a boundary of a district is a reference to a boundary existing immediately before the commencement of this Order.

Application of Regulations

3.  Save insofar as they can have no application in relation to the area changes effected by this Order, the provisions of the 1977 Regulations shall apply in relation thereto for the purposes of, or in consequence of, this Order.

Area changes

4.—(1) Those areas of the City of Glasgow District, being the Area A and Area B described in Part I of the Schedule to this Order and shown delineated, hatched and marked “A” and “B” on the boundary map, shall be transferred to Eastwood District.

(2) Part of Eastwood District, being the Area C described in Part II of the Schedule to this Order and shown delineated, hatched and marked “C” on the boundary map, shall be transferred to the City of Glasgow District.

Consequential changes of electoral arrangements

5.—(1) Area A described in Part I of the Schedule to this Order (being the Area A transferred by article 4(1) of this Order)—

(a)shall cease to form part of electoral division 36 (Pollokshaws/Newlands) of Strathclyde Region((3)) and of ward 56 (Newlands) of the City of Glasgow District((4)); and

(b)shall form part of electoral division 70 (Eastwood North) of Strathclyde Region and of ward 3 (Giffnock East) of Eastwood District((5)).

(2) Area B described in Part I of the Schedule to this Order (being the Area B transferred by article 4(1) of this Order)—

(a)shall cease to form part of electoral division 36 (Pollokshaws/Newlands) of Strathclyde Region and of ward 56 (Newlands) of the City of Glasgow District; and

(b)shall form part of electoral division 70 (Eastwood North) of Strathclyde Region and of ward 4 (Netherlee) of Eastwood District.

(3) Area C described in Part II of the Schedule to this Order (being the Area C transferred by article 4(2) of this Order)—

(a)shall cease to form part of electoral division 70 (Eastwood North) of Strathclyde Region and of ward 4 (Netherlee) of Eastwood District; and

(b)shall form part of electoral division 36 (Pollokshaws/Newlands) of Strathclyde Region and of ward 56 (Newlands) of the City of Glasgow District.

Articles 2, 4 and 5

SCHEDULE

PART I

Area A

The area bounded by a line commencing at a point on the district boundary grid reference NS 5736 5970, northeastwards to and thereafter southeastwards along the centre line of Muirend Road to a point grid reference NS 5755 5967; then southwestwards along a railway line to rejoin the district boundary, then northwestwards and northeastwards along that boundary to the point of commencement.

Area B

The area bounded by a line commencing at the northeastern corner of Area A as described above, then southeastwards along the centre line of Muirend Road to its junction with Clarkston Road; then northeastwards along the centre line of Clarkston Road to its junction with Brenfield Road, then northeastwards along the centre line of Brenfield Road to a point grid reference NS 5778 5966; then southeastwards and thereafter generally northeastwards along the wall which forms the rear boundary of properties at Nos 24-106 Brenfield Road to a point on the south side of Brenfield Road grid reference NS 5799 5977, thereafter generally northeastwards along the boundary wall of Cathcart Cemetery at Brenfield Road to rejoin the district boundary; then southwestwards, northwestwards, southwestwards and northwestwards along that boundary to the southeastern boundary of Area A; then northeastwards along that boundary to the point of commencement.

PART II

Area C

The area bounded by a line commencing at the northeastern corner of Area B as described above, southwestwards along the southeastern boundary of Area B to the Prayer House at the Hebrew Cemetery, then southeastwards along the northeastern wall of that Prayer House to the cemetery wall and continuing southeastwards by that cemetery wall to where it meets the north boundary wall of Our Lady of the Missions School, then southwestwards and southeastwards by that wall to rejoin the district boundary, then eastwards, southwards, eastwards again, generally northwestwards and then generally southwestwards along that boundary to the point of commencement.

Explanatory Note

(This note is not part of the Order)

This Order transfers 2 areas extending in total to approximately 20 acres from the City of Glasgow District to Eastwood District and an area of approximately 20 acres from Eastwood District to the City of Glasgow District and makes consequential changes to electoral arrangements.

The map annexed to and forming part of this note gives a general guide to the area affected by this Order as from 1st April 1989.

Copies of the detailed boundary map defined in article 2 of this Order may be inspected at the offices of the local authorities referred to in this Order, and may be inspected at or purchased from the Scottish Development Department’s Map Library, New St Andrew’s House, St James Centre, Edinburgh, EH1 3SZ.
