The Motor Vehicles (Tests) (Amendment) Regulations 1989

The Secretary of State for Transport, in exercise of the powers conferred by section 43(2) and (6) of the Road Traffic Act 1972 (“the 1972 Act”)1 and now vested in him2 and by the Department of Transport (Fees) Order 19883 and of all other enabling powers, and after consultation with representative organisations in accordance with section 199(2) of the 1972 Act, hereby makes the following Regulations:–

These Regulations may be cited as the Motor Vehicles (Tests) (Amendment) Regulations 1989 and shall come into force on 3rd April 1989.

The Motor Vehicles (Tests) Regulations 19814 are hereby amended so that in the regulations specified in column 1 of the Table below for the amounts specified in column 2 of the Table there are substituted the amounts specified in column 3 of the Table.

These Regulations amend the Motor Vehicles (Tests) Regulations 1981 in relation to Class VI vehicles (public service vehicles other than those of a type specified in regulation 5(3)) so that–

a

the fee payable for the examination of a vehicle is increased from £34.50 to £36.25 if the vehicle is constructed or adapted to carry more than 12 passengers, and from £24 to £25.25 in any other case. These increases apply in respect of an examination following an application under regulation 12 and to a further examination after an interval of more than 14 days from the date of the issue of the notice of refusal of a test certificate;

b

the fee payable for the further examination of a vehicle within 14 days of the date of the issue of the notice of refusal of a test certificate is increased from £17 to £17.75 if the vehicle is constructed or adapted to carry more than 12 passengers and from £12 to £12.50 in any other case; and

c

the fee payable for the issue of a duplicate test certificate is increased from £7.50 to £7.75.
