SCHEDULE 1TIME LIMITS FOR MAKING APPLICATIONS OR APPEALS

1.  Appeal to a tribunal from an adjudication officer’s decision (regulation 5).

An appropriate social security office.3 months beginning with the date when notice in writing of the decision was given to the appellant.

2.  Application to the Chairman for leave to appeal to a Commissioner from the decision of a tribunal (paragraph 16, Schedule 2).

The office of the Clerk to the tribunal3 months beginning with the date when a copy of the record of the decision was given to the applicant.

3.  Application to–

(a)an adjudication officer;

(b)a tribunal; or

(c)a Commissioner, to set aside decision (regulation 8).

(a)An appropriate social security office;

(b)The Office of the clerk to the tribunal;

(c)The office of the Social Security Commissioners.

(a)and (b) 3 months beginning with the date when notice in writing of the decision was given to the applicant.

(c)30 days from the date on which notice in writing of the decision was given to the applicant by the office of the Social Security Commissioners.

4.  Application for leave to appeal to the Commissioner where the chairman has refused leave (paragraph 17 Schedule 2).

5.  Appeal to the Commissioner (regulation 5).

6.  Leave to appeal to the Court of Session (regulation 5(4)).
