Coming into force

The Secretary of State for Transport, in exercise of the powers conferred by section 14 of the Harbours Act 19641 and now vested in him2, and of all other powers enabling him in that behalf, and on the application of the Medway Ports Authority, hereby makes the following Order:-

Citation and commencement1

This Order may be cited as the Medway Ports Authority Harbour Revision Order 1989 and shall come into force on 3rd May 1989.

Interpretation2

In this Order “the Act of 1973” means the Medway Ports Authority Act 19733, “the added limits” means the area described in the Schedule to this Order and expressions to which meanings are assigned by the Act of 1973 have the same respective meanings.

Extension of limits3

The limits within which the Authority and the harbour master have jurisdiction in accordance with the Act of 1973 are hereby extended to include the added limits.

All enactments conferring rights, powers, privileges and immunities or imposing duties, obligations and liabilities upon the Authority and all byelaws and regulations made by the Authority which related to or were in force in the port immediately before the coming into force of this Order shall relate to and have effect in the added limits.

Section 3 (Interpretation) of the Act of 1973 shall have effect as if at the end of the definition of “the port” there were inserted the words “and includes the added limits as defined in the Medway Ports Authority Harbour Revision Order 1989”.

SCHEDULEDESCRIPTION OF ADDED LIMITS

An area bounded by an imaginary line drawn from Garrison Point Navigational Light (position 51 degrees 26.788 minutes North 00 degrees 44.738 minutes East) in a 305 degrees (true) direction for 143 metres, thence in a 045 degrees (true) direction for 273 metres, thence in a 090 degrees (true) direction for 250 metres and thence in a 180 degrees (true) direction for 355 metres to the shore line.

This Order extends the limits within which the Medway Ports Authority has jurisdiction to include a portion of the river Thames adjacent to Garrison Point, Sheerness.
