MISCELLANEOUS

If an installation owner, installation manager or employer fails to comply with an obligation imposed upon him by these Regulations he shall be guilty of an offence.
2
In proceedings for an offence under this regulation, it shall be a defence for the person charged to prove–
a
that he exercised all due diligence to prevent the commission of the offence; and
b
that the relevant failure to comply was committed without his consent connivance or wilful default.
