The Royal Air Force Terms of Service (Amendment) Regulations 1989

The Defence Council, in exercise of the powers conferred upon them by section 2 of the Armed Forces Act 1966(1), hereby make the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Royal Air Force Terms of Service (Amendment) Regulations 1989 and shall come into force on 1st October 1989.

Amendments to Regulations

2.  The Royal Air Force Terms of Service Regulations 1985(2) shall be further amended as follows.

3.  There shall be inserted after Regulation 7 a new Regulation as follows—

Right to Transfer to the Reserve-Aircrew Category

7A.(1) Without prejudice to the right referred to in Regulation 7(1), a person to whom this Regulation applies shall have the right to be transferred to the reserve under this Regulation. Such transfer shall take effect on the date which is:

(a)8 years from the relevant date, or

(b)6 years from the end of his period of training, whichever is the later.

(2) This Regulation applies to a person in air force service who enlisted for service in an aircrew category and who has not been transferred from such category.

(3) The right referred to in paragraph (1) shall be exercisable in accordance with Regulation 11 and is subject to Regulation 12..

4.—(1) In Regulation 11 (exercise of certain rights) for “Regulations 5, 6 or 7” there shall be substituted “Regulations 5,6, 7 or 7A”.

(2) In Regulation 12 (restrictions on the exercise of rights conferred by Regulations 5, 6, 7 and 15(2)) for “Regulations 5, 6, 7 and 15(2)” there shall, in each place those words occur, be substituted “Regulations 5,6,7,7A and 15(2)”.

(3) In Regulation 13 (service in the reserve) for “Regulations 5, 6 and 7” there shall be substituted “Regulations 5,6,7 and 7A”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Royal Air Force Terms of Service Regulations 1985 by giving an additional right to transfer to the reserve to certain persons serving in an aircrew category.
