ELECTRICITY

The Electricity Act 1989 (Commencement No. 2) Order 1990

The Secretary of State, in exercise of the powers conferred by section 113(2) of the Electricity Act 1989(1) and of all other enabling powers, hereby makes the following Order:

1.—(1) This Order may be cited as the Electricity Act 1989 (Commencement No. 2) Order 1990.

(2) In this Order “the Act” means the Electricity Act 1989.

2.  Section 85 of the Act shall come into force on 1st March 1990.

3.  The following provisions of the Act shall come into force on 31st March 1990 —

(a)the provisions specified in Schedule 1 to this Order;

(b)section 112(4) except insofar as it relates to the provisions specified in Schedule 2 to this Order, and Schedule 18 except for those provisions; and

(c)Schedule 17, except for paragraph 3(b) and the word “and” immediately preceding it.

Explanatory Note

(This note is not part of the Order)

This Order brings into force —

(a)section 85 of the Electricity Act 1989 (“the Act”) on 1st March 1990; and

(b)on 31st March 1990 the other provisions of the Act which are not already in force except certain repeals specified in Schedule 2 to this Order and also except Schedule 17, paragraph 3(b).

The repeals which are not brought into force relate to the Electricity Council and the Electricity Boards which, by virtue of section 84 of the Act, continue in existence.
