The Secretary of State, in exercise of the powers conferred upon him by sections 115(1) and 123(1) of the Patents Act 1977(1),after consultation with the Council on Tribunals pursuant to section 10(1) of the Tribunals and Inquiries Act 1971(2), hereby makes the following Rules:—

1.  The Rules may be cited as the Patents (Amendment) Rules 1990 and shall come into force on 13th August 1990.

2.  Rule 90 of the Patents Rules 1982(3) is amended by omitting paragraphs (3) and (4) thereof.

Explanatory Note

(This note is not part of the Rules)

These Rules revoke paragraphs (3)and (4) of Rule 90 of the Patents Rules 1982, which authorised the comptroller to refuse to recognise certain agents in respect of any business under that Act. The revocation is consequential on the coming into force of section 281 of the Copyright, Designs and Patents Act 1988 (c. 48) and the making of rules thereunder to authorise the Comptroller-General of Patents, Designs and Trade Marks to refuse to deal with certain agents — see S.I.1990/1454 (The Patents Agents (Non-recognition of Certain Agents by Comptroller) Rules 1990).
