The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 19881, and of all other powers enabling him in that behalf, hereby makes the following Order:–

This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (England) (Amendment) Order 1990 and shall come into force on 30th August 1990.

In article 2 of the Local Government Act 1988 (Defined Activities) (Exemptions) (England) Order 19882, after paragraph (2), there shall be inserted–

References in this Order to section 2(2) of the Act3 are references to that section as amended from time to time by the addition of paragraphs by order made under section 2(3) of the Act.

The Local Government Act 1988 (Defined Activities) (Exemptions) (England) Order 1988 (S.I.1988/1372) provides that an activity listed in section 2(2) of the Local Government Act 1988 shall not be treated as a defined activity for the purpose of that Act so long as specified conditions are fulfilled.

This Order amends that Order so as to extend its application to activities added to section 2(2) by order made under section 2(3).
