The Secretary of State for Health, in exercise of powers conferred by sections 35(1), 36(1), 37(1)(a), (1A) and (1B), 43(1), 78(1A), 79(1), 79A, 81, 83 and 126(4) of, and paragraphs 2(6) and 3(5) of Schedule 12 to, the National Health Service Act 1977(1) and of all other powers enabling him in that behalf and after consultation with the Council on Tribunals in accordance with section 10 of the Tribunals and Inquiries Act 1971(2) and with such organisations as appear to him to be representative of persons providing general dental services in accordance with section 37(1B) of the National Health Service Act 1977(1), hereby makes the following Regulations:—
1977 c. 49; in section 128(1) see the definitions of and Section 35(1) was substituted by S.I. 1985/39, article 7(9). Section 36 was amended by S.I. 1981/432, article 3(3), the Health and Social Security Act 1984 (c. 48) ( 1984 Act section 5(4) and Schedule 3, paragraph 5, S.I. 1985/39, article 7(10), the Health and Medicines Act 1988 (c. 49) ( 1988 Act section 25(1) and Schedule 2, paragraph 4 and the National Health Service and Community Care Act 1990 (c. 19) ( 1990 Act section 24 ( see S.I. 1990/1329) and was extended by section 17 of the 1988 Act. Section 37 was renumbered so as to become section 37(1), and subsections (1A) and (1B) were inserted, by section 12(2) and (3) respectively of the 1988 Act. Section 43(1) was amended by the Health Services Act 1980 (c. 53), ( 1980 Act section 21(2) and Schedule 1, paragraph 55, S.I. 1985/39, article 7(15) and the 1990 Act, section 66(1) and Schedule 9, paragraph 18(2). Section 78(1A) and section 79A were inserted by, and section 79 amended by, the 1988 Act, section 11. Section 81 was amended by the 1984 Act, section 24 and Schedule 8. Section 83 was amended by the 1980 Act, Schedule 1, paragraph 64 and the 1984 Act, section 24 and Schedule 8.
