The Outer Space Act 1986 (Guernsey) Order 1990

The Counsellors of State in Council

Whereas Her Majesty in pursuance of the Regency Acts 1937 to 1953, was pleased, by Letters Patent dated the 18th day of January 1990 to delegate to the six Counsellors of State therein named or any two or more of them full power and authority during the period of Her Majesty’s absence from the United Kingdom to summon and hold on Her Majesty’s behalf Her Privy Council and to signify thereat Her Majesty’s approval for anything for which Her Majesty’s approval in Council is required:

Now, therefore, Her Majesty Queen Elizabeth The Queen Mother and His Royal Highness The Prince Charles, Prince of Wales, being authorised thereto by the said Letters Patent, and in pursuance of sections 2(3) and 15(6) of the Outer Space Act 1986(1), do on Her Majesty’s behalf order, and it is hereby ordered, as follows:

1.  This Order may be cited as the Outer Space Act 1986 (Guernsey) Order 1990 and shall come into force on 14th March 1990.

2.  The application of the Outer Space Act 1986 is hereby extended to bodies incorporated under the law of any part of the Bailiwick of Guernsey.

3.  It is hereby directed that the Outer Space Act 1986 shall apply to the Bailiwick of Guernsey subject to the exceptions and modifications specified in the Schedule to this Order.

Article 3

SCHEDULEEXCEPTIONS AND MODIFICATIONS IN THE APPLICATION OF THE OUTER SPACE ACT 1986 TO THE BAILIWICK OF GUERNSEY

1.  Any reference to an enactment shall be construed, unless the contrary intention appears, as a reference to that enactment as it has effect in the Bailiwick of Guernsey.

2.  In section 1, for “the United Kingdom” there shall be substituted “the Bailiwick of Guernsey”.

3.—(1) In section 2(1)–

(a)the words “Scottish firms,” shall be omitted, and

(b)for “the United Kingdom” there shall be substituted “the Bailiwick of Guernsey”.

(2) Section 2(3) shall be omitted.

4.  Section 3(4) shall be omitted.

5.  In section 8(3), for the words from “the Secretary of State” to the end there shall be substituted “Her Majesty’s Procureur or Comptroller by injunction”.

6.—(1) In section 9(1), for “a justice of the peace” there shall be substituted “the Bailiff”.

(2) Section 9(6) shall be omitted.

7.  Section 11(2) shall be omitted.

8.  In section 12(4) and (6), for “United Kingdom” wherever appearing there shall be substituted “Bailiwick of Guernsey”.

9.  In section 13(1), the definition of “dependent territory” shall be omitted.

10.  In section 14, the entry in the Table relating to “dependent territory” shall be omitted.

11.—(1) In section 15(4)–

(a)for “commencement of this Act” there shall be substituted “date on which the Outer Space Act 1986 (Guernsey) Order 1990 comes into force”, and

(b)for “after commencement” there shall be substituted “after that date”.

(2) Section 15(2), (3), (5) and (6) shall be omitted.

Explanatory Note

(This note is not part of the Order)

This Order extends the Outer Space Act 1986 to bodies incorporated under the law of the Bailiwick of Guernsey and applies that Act to the Bailiwick subject to the exceptions and modifications specified in the Schedule to the Order.
