Citation and commencement

1.  This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (England) (No. 2) Order 1990 and shall come into force on 1st April 1990.

Interpretation

2.  In this Order—

“the Act” means the Local Government Act 1988;

“cleaning” means the cleaning of buildings transferred to an authority mentioned in article 4 hereof by the Education (Inner London Education Authority) (Property Transfer) Order 1990(2);

“catering” means catering for the purposes of schools so transferred; and

“vehicle maintenance” means the repair and maintenance of vehicles so transferred.

Exemptions

3.  Cleaning, catering and vehicle maintenance, being, respectively, defined activities within section 2(2)(b), (d) and (g) of the Act, shall not be treated as such activities if carried out by a specified authority before the date specified in relation to that activity and that authority in the table in the Schedule hereto.

Authorities

4.  For the purpose of this Order the specified authorities are—

(a)the councils of the London boroughs of Lambeth, Southwark, Greenwich, Lewisham;

(b)the councils of the London boroughs of Kensington and Chelsea, Wandsworth, Camden, Hackney, Tower Hamlets;

(c)the common Council of the City of London in its capacity as a local authority and the councils of the London boroughs of Hammersmith and Fulham, Islington, Westminster.
