These Regulations have been made in consequence of a defect in S.I. 1990/468 and are being issued free of charge to all known recipients of that Statutory Instrument.

The Secretary of State, in exercise of the powers conferred on him by sections 19, 25, 27, 69, 75(a), 105 and 108(1) of, and paragraph 1 of Schedule 11 to, the National Health Service (Scotland) Act 1978(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the National Health Service (Charges for Drugs and Appliances) (Scotland) Amendment (No.2) Regulations 1990 and shall come into force on 1st April 1990.

(2) In these Regulations “the amending Regulations” means the National Health Service (Charges for Drugs and Appliances) (Scotland) Amendment Regulations 1990(2).

Amendment of the amending Regulations

2.  In regulation 4 of the amending Regulations for the words “where drugs are supplied” there shall be substituted the words “in relation to supplies of drugs and appliances made”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the National Health Service (Charges for Drugs and Appliances) (Scotland) Amendment Regulations 1990 (“the amending Regulations”) which amend Regulations providing for the making and recovery of charges for drugs and appliances under the National Health Service (Scotland) Act 1978.

The amendment effected by these Regulations corrects a minor omission from the provisions of the amending Regulations in relation to the application of the Regulations to drugs and appliances.
