The National Health Service (General Dental Services) (Scotland) Amendment Regulations 1991

The Secretary of State, in exercise of the powers conferred on him by sections 25(1) and (2), 105(7) and 108(1) of the National Health Service (Scotland) Act 1978(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the National Health Service (General Dental Services) (Scotland) Amendment Regulations 1991 and shall come into force on 1st July 1991.

(2) In these Regulations, a reference to “the principal Regulations” is to the National Health Service (General Dental Services) (Scotland) Regulations 1974(2).

Amendment of the principal Regulations

2.—(1) The principal Regulations shall be amended in accordance with the following paragraphs of this regulation.

(2) In paragraph 16(2) of Schedule 1 (terms of service for dentists)–

(a)after head (m) there is inserted the following head:–

(mm)any treatment immediately necessary as a result of trauma;;

(b)in head (n) after “(f)” there are inserted the words “and (mm)”;

(c)in head (o) for the words “and (k)” there are substituted the words “, (k) and (mm)”;

(d)in head (p) after “(k)” there are inserted the words “and (mm)”; and

(e)in head (q) for the words “and (m)” there are substituted the words “, (m) and (mm)”.

(3) In Part II of Schedule 1C (prior approval treatment)–

(a)in paragraph 1 (course of care and treatment) for “£500” there is substituted “£600”; and

(b)in paragraph 2 (orthodontic care and treatment) for “£500” there is substituted “£600”.

Application of these Regulations

3.  The amendments made by regulation 2(3) of these Regulations apply only in relation to a course of care and treatment or to any orthodontic care and treatment commenced on or after 1st July 1991.

Explanatory Note

(This note is not part of the Regulation)

These Regulations amend the National Health Service (General Dental Services) (Scotland) Regulations 1974 (“the 1974 Regulations”), which provide for the arrangements under which dentists provide general dental services as part of the National Health Service in Scotland.

Regulation 2(2) adds a further item to the list of items of treatment which a dentist can provide as occasional treatment.

Regulation 2(3) amends Schedule 1C of the 1974 Regulations to increase from £500 to £600 the maximum cost of a course of care and treatment or any orthodontic care and treatment which a dentist may provide without first seeking the prior approval of the Scottish Dental Practice Board. These amendments apply only in relation to care and treatment commenced on or after 1st July 1991 (regulation 3).
