Coming into force

The Secretary of State, in exercise of the powers conferred upon him by section 140(5) of the Environmental Protection Act 19901 and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement1

This Order may be cited as the Advisory Committee on Hazardous Substances Order 1991 and shall come into force on 25th July 1991.

Establishment of the Advisory Committee on Hazardous Substances2

A Committee, called the Advisory Committee on Hazardous Substances, is hereby established to give the Secretary of State advice in relation to the exercise of the power to make regulations under section 140 of the Environmental Protection Act 1990.

This Order establishes the Advisory Committee on Hazardous Substances. The Secretary of State is required, except in certain circumstances, to consult the Committee before exercising the powers conferred on him by section 140(1) of the Environmental Protection Act 1990 to prohibit or restrict by regulations the importation, use, supply or storage of injurious substances or articles. Under section 142(3) of the 1990 Act, the Secretary of State is similarly required to consult the Advisory Committee before making an order specifying potentially hazardous substances under subsection (1) of that section.
