The Advisory Committee on Hazardous Substances (Terms of Office) Regulations 1991

Coming into force

The Secretary of State, in exercise of the powers conferred upon him by paragraph 3 of Schedule 12 to the Environmental Protection Act 19901 and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation1

These Regulations may be cited as the Advisory Committee on Hazardous Substances (Terms of Office) Regulations 1991 and shall come into force on 25th July 1991.

In these Regulations “the Committee” means the Committee established by the Advisory Committee on Hazardous Substances Order 19912.

Terms of Office2

Each member of the Committee, including the person appointed as chairman:

a

shall be appointed initially for a period, not exceeding three years, ending on the 31st December;

b

may be re-appointed for one or more further periods of three years; and

c

may, by notice in writing addressed to the Secretary of State, resign his membership.

If the Secretary of State is satisfied that a member of the Committee (including the person appointed as chairman):

a

is incapacitated by mental or physical illness; or

b

has been absent from three consecutive meetings of the Committee; or

c

is otherwise unable or unfit to discharge the functions of a member, or is unsuitable to continue as a member;

the Secretary of State may remove him from his office.
