The Dentists Act 1984 (Dental Auxiliaries) Amendment Order 1991

Present,

The Queen’s Most Excellent Majesty in Council

Whereas a draft of this Order has been approved by a resolution of each House of Parliament in accordance with section 46(5) of the Dentists Act 19841;

Now, therefore, Her Majesty, in exercise of the powers conferred upon Her by section 46(4)(b) of that Act and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

Citation and commencement1

This Order may be cited as the Dentists Act 1984 (Dental Auxiliaries) Amendment Order 1991 and shall come into force forthwith.

Amendment of section 46 of the Dentists Act 19842

In section 46 of the Dentists Act 1984 (restrictions on employment of dental auxiliaries)—

a

in subsection (2) the words “in the course of the provision of national health services”; and

b

subsection (3),

are hereby repealed.

This Order amends section 46 of the Dentists Act 1984 (which places restrictions on employment of dental auxiliaries) to provide that Regulations made under section 45 must secure that dental work whether or not National Health Service work carried out by a dental auxiliary must be carried out under the direction of a registered dentist rather than under the personal supervision of a registered dentist (article 2).
