Where during the temporary set-aside period there is a change of occupation on a holding of the whole or part of the area set aside under the Community Scheme, the original occupier shall no longer be treated as a beneficiary and accordingly shall not be entitled to aid.

Where during the temporary set-aside period there is a change of occupation on a holding of the whole or part of an area other than the area set aside the original occupier may continue to be treated as a beneficiary.
