Explanatory Note

(This note is not part of the Order)

This Order brings into force sections 9 and 10 of the Administration of Justice Act 1985 (incorporated practices). Section 9 allows the Council of the Law Society to make rules regulating the carrying on of a solicitor’s practice through bodies corporate, brings into force the provisions of Schedule 2 to the Act (“Incorporated Practices: Supplemental Provisions”) and empowers the Lord Chancellor to apply provisions relating to Solicitors to such bodies corporate (with or without modification). Section 10 establishes an offence of pretending to be a body recognised under section 9.
