The Secretary of State for the Environment, as respects England, the Secretary of State for Wales, as respects Wales, and the Secretary of State for Scotland, as respects Scotland, in excercise of the Powers conferred on them by section 86(8) of the Environmental Protection Act 19901 and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement1

This order may be cited as the Litter (Relevant Land of Principal Litter Authorities and Relevant Crown Land) Order 1991 and shall come into force on 1st April 1991.

Relevant Land2

For the purposes of Part IV of the Environmental Protection Act 1990, land below the place to which the tide flows at mean high water springs is not to be treated as relevant land of principal litter authorities or as relevant Crown land.

This Order is made under section 86(8) of the Environmental Protection Act 1990, which empowers the Secretary of State to designate descriptions of land which are not to be treated as relevant land for the purposes of Part IV of that Act (Litter etc.) The Order designates land below the place to which the tide flows at mean high water spring tide as land which is not relevant land of principal litter authorities or relevant Crown land.
