The District of South Herefordshire (Electoral Arrangements) Order1991

Coming into force in accordance with article 2

Whereas in pursuance of section 51(1) of the Local Government Act19721, the Local Government Boundary Commission for England on14th May 1990 submitted proposals for the future electoral arrangementsfor the District of South Herefordshire;

Now, therefore, in exercise of the power conferred upon me bysections 51(2) and 67 of that Act, I hereby make the following Order:

This Order may be cited as the District of South Herefordshire(Electoral Arrangements) Order 1991.

This Order shall come into force on 2nd May 1991 except that for thepurpose of all proceedings preliminary or relating to an election to beheld on or after that day, it shall come into force forthwith.

The existing wards of the District of South Herefordshire shall beabolished and that district shall be divided into thirty-three wardswhich shall bear the names set out in column 1 of Schedule 1 to thisOrder, and each such ward shall comprise the existing areas specifiedopposite thereto in column 2 of that Schedule.

The number of councillors to be elected for each ward constituted byparagraph (1) above shall be the number specified in column 3 of theSchedule 1 to this Order opposite to the name of the ward as given incolumn 1 of that Schedule.

Subject to the provisions of article 5 below, the elections ofcouncillors shall be by thirds.

Subject to the provisions of article 5 below, the order ofretirement of councillors shall be as set out in Schedule 2 to thisOrder.

The councillors who immediately before the coming into force of thisOrder represent the existing Broad Oak, Burghill, Burmarsh, DinedorHill, Dinmore Hill, Golden Valley, Kingsthorne, Merbach, Munstone,Olchon, Pontrilas, Ross-on-Wye East,Ross-on-Wye West, Thinghill, TramInn and Whitfield wards of the District shall represent the ward of thesame name as constituted by this Order.

Any casual vacancy existing immediately before the coming into forceof this Order in the representation of one of those existing wards shallbe deemed to exist in the representation of the ward of the same name asconstituted by this Order.

The councillors for the Backbury, Clehonger East, Clehonger West,Credenhill, Doward, Fownhope, Garron, Gorsley, Hagley, Harewood End,Hollington, Old Gore, Penyard, Stoney Street, Swainshill, Walford andWilton wards of the District as constituted by this Order shall beelected at the ordinary elections of councillors in 1991.

Two councillors for each of the Ross-on-Wye East and Ross-on-Wye West wards of the District as constituted by this Order shall be elected at the ordinary elections of councillors in 1991.

The councillors elected in 1991 for the Backbury, Clehonger West,Credenhill, Hagley, Hollington and Swainshill wards of the Districtshall retire in 1994.

The councillor elected in 1991 for the Stoney Street ward of theDistrict shall retire in 1992.

Of the councillors elected in 1991 for the Clehonger East andRoss-on-Wye West wards of the District, other than on an election tofill a casual vacancy—

a

one shall retire in 1992 being, subject to paragraphs (10) and (11)below, the councillor elected by the smaller number of votes;

b

the remaining councillor shall retire in 1995.

Both the councillors elected in 1991 for the Ross-on-Wye East wardof the District, other than on an election to fill a casual vacancy,shall retire in 1995.

In the case of an equality of votes between any persons electedwhich makes it uncertain which of them is to retire in any such year,the person to retire in that year shall be determined by lot.

If an election of councillors for the Clehonger East ward or theRoss-on-Wye West ward of the District is not contested, the person toretire in each such year shall be determined by lot.

Where under this article any question is to be determined by lot,the lot shall be drawn at the next practicable meeting of the councilafter the question has arisen, and the drawing shall be conducted underthe direction of the person presiding at the meeting.

Except as otherwise provided in the foregoing paragraphs of thisarticle, the term of office of councillors shall be four years, and allcouncillors shall retire on the fourth day after the ordinary day ofelection of councillors of the district in the year of retirement andthe newly elected councillors shall come into office on the day on whichtheir predecessors retire.

In this article“the District” means the District of South Herefordshire.

The ordinary elections of parish councillors elected in 1991 for anyparish or ward of a parish situated in the Hollington ward of theDistrict of South Herefordshire shall take place in 1994 and thereafterordinary elections shall take place every fourth year.

The ordinary elections of parish councillors for any parish or wardof a parish situated in the Backbury, Broad Oak, Burghill, Burmarsh,Credenhill, Dinedor Hill, Dinmore Hill, Golden Valley, Hagley,Kingsthorne, Merbach, Munstone, Olchon, Pontrilas, Stoney Street,Swainshill, Thinghill, Tram Inn and Whitfield wards of the District ofSouth Herefordshire shall take place in the ordinary year of election ofthe councillor for the district ward in which the parish or ward of theparish is situated.

The ordinary elections of parish councillors for the parish ofClehonger shall take place in 1992 and every fourth year thereafter.

The parish councillors to whom the foregoing paragraphs of thisarticle apply shall retire on the fourth day after the ordinary day ofelection of parish councillors in the year of retirement and the newlyelected councillors shall come into office on the day on which theirpredecessors retire.

The registration officer shall make such re-arrangement oralteration of the register of local government electors as may benecessary on account of the coming into force of this Order.
