The Broadcasting (Channel 3 Transmission and Shared Distribution Costs) Order 1991

In exercise of the powers conferred upon me by section 66(1) and (2) of the Broadcasting Act 1990(1), I hereby make the following Order:

1.  This Order may be cited as the Broadcasting (Channel 3 Transmission and Shared Distribution Costs) Order 1991 and shall come into force on 11th May 1991.

2.  I hereby specify that the period during which–

(a)all Channel 3 services shall be broadcast for general reception by a single person under arrangements made with him by the persons licensed to provide those services; and

(b)all persons licensed to provide Channel 3 services shall share the costs incurred in respect of the distribution of those services (taken as a whole) in such manner as may be approved by me,

shall begin on 1st January 1993 and end with 31st December 1996.

Explanatory Note

(This note is not part of the Order)

This Order provides that all Channel 3 services shall be broadcast for general reception by a single person under arrangements made with him by the persons licensed to provide those services from 1st January 1993 to 31st December 1996.

The Order further provides that all Channel 3 licensees shall share the distribution costs of those services in such manner as may be approved by the Secretary of State for the same period. By ‘distribution costs’ is meant the costs of the conveyance of Channel 3 services (by whatever means and whether directly and indirectly) to the broadcasting stations from which those services are broadcast for general reception: see section 66(2) of the Broadcasting Act 1990.
