The Secretary of State for Transport, in exercise of the powers conferred by sections 45 and 46 of the Road Traffic Act 1988(1) and by the Department of Transport (Fees) Order 1988(2), and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Motor Vehicles (Tests) (Amendment) (No. 2) Regulations 1992 and shall come into force—

(a)for the purposes of regulations 4 and 5 on 1st January 1993, and

(b)for all other purposes on 1st August 1992.

Introduction

2.  The Motor Vehicles (Tests) Regulations 1981(3) shall be further amended in accordance with the provisions of these Regulations.

Amendments coming into force on 1st August 1992

3.  In the regulations specified in column 1 of the Table below for the amounts specified in column 2 of the Table there shall be substituted the amounts specified in column 3 of the Table.

Amendments coming into force on 1st January 1993

4.  In regulation 20, for sub-paragraph (b) in paragraph (1) there shall be substituted—

(aa)in the case of a motor bicycle with a side car attached to it, £17.30;

(b)in the case of a vehicle in Class III, £20.30;.

5.  In the regulations specified in column 1 of the Table below for the amounts specified in column 2 of the Table (as substituted by regulation 3 above) there shall be substituted the amounts specified in column 3 of the Table.

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Motor Vehicles (Tests) Regulations 1981 as follows.

Amendments coming into force on 1st August 1992

1.  Fees for test examinations are increased as follows:

(a)motor bicycles not having a side car attached, from £10.00 to £10.35;

(b)vehicles in Class III (“light motor vehicles” other than motor bicycles) or motor bicycles with a side car attached, from £16.65 to £17.30;

(c)vehicles in Class IV (“motor cars” and “heavy motor cars” not being vehicles within Classes III, V, VI or VII), from £20.00 to £21.00;

(d)vehicles in Class V (“large passenger-carrying vehicles”, particular public service vehicles and “play buses”), from £19.30 to £29.15; and

(e)vehicles in Class VII (goods vehicles with a design gross weight of more than 3,000 kgs but not more than 3,500 kgs), from £22.60 to £23.50.

2.  The fee payable for the supply of 100 forms of test certificate is reduced from £44.50 to £36.00.

Amendments coming into force on 1st January 1993

3.  Fees for certain test examinations will be further increased (further to those mentioned in paragraph 1 of this note) as follows:

(a)vehicles in Class III, from £17.30 to £20.30;

(b)vehicles in Class IV, from £21.00 to £24.00;

(c)vehicles in Class V, from £29.15 to £30.35; and

(d)vehicles in Class VII, from £23.50 to £26.50.

Fees on appeal and fees for duplicate test certificates

4.  In the case of the vehicles mentioned in paragraphs 1 and 3 of this note, the fee payable on an appeal, where a notice of the refusal of a test certificate has been issued, is the same amount as the fee payable under regulation 20(1), while the fee for a duplicate test certificate is one half of this amount. These fees will be increased accordingly.
