These Regulations define the circumstances in which a street authority, in cases where the undertaker has failed to afford to that authority facilities for inspecting its relevant apparatus (as defined in regulation 2) in a street, may carry out works to enable them to inspect the apparatus where they have reasonable cause to believe that the apparatus has not been maintained as required by section 81(1) and (2) of the New Roads and Street Works Act 1991. Where the inspection shows that the apparatus has not been so maintained the street authority may carry out emergency works needed in consequence of the undertaker’s breach of statutory duty.
