The Civil Courts (Amendment No. 3) Order 1992

The Lord Chancellor, in exercise of the powers conferred on him by section 67(1) and (2) of the Race Relations Act 1976(1); by sections 2 and 26 of the County Courts Act 1984(2) and by sections 117(4) and 374 of the Insolvency Act 1986(3), hereby makes the following Order:—

1.  This Order may be cited as the Civil Courts (Amendment No. 3) Order 1992 and shall come into force on 24th August 1992.

2.  The holding of the Bloomsbury and Westminster County Courts shall be discontinued.

3.—(1) A county court shall be established at Marylebone which shall be known as the Central London County Court.

(2) The Central London County Court shall have jurisdiction in proceedings commenced in the Bloomsbury or Westminster County Courts before this Order comes into force.

(3) No process shall be invalid only because the holding of the court described therein by name has been discontinued by this Order.

(4) The Central London County Court shall be designated for the purposes of the Race Relations Act 1976.

(5) For the purposes of section 26 of the County Courts Act 1984 the district of the Central London County Court shall be assigned for admiralty purposes to the Mayor’s and City of London Court.

(6) For the purposes of sections 117(4) and 374 of the Insolvency Act 1986 the Central London County Court shall be excluded from having jurisdiction under those provisions.

4.  Schedule 3 to the Civil Courts Order 1983(4) shall be amended as follows—

(a)the entries relating to Bloomsbury and Westminster shall be deleted; and

(b)after the entry relating to Market Drayton, there shall be inserted the following new entry—

5.  Schedule 4 to the Civil Courts Order 1983 shall be amended by inserting, after the entry relating to Margate, the following—

11A.  The name of the county court at Marylebone shall be the Central London County Court..

Explanatory Note

(This note is not part of the Order)

This Order amends the Civil Courts Order 1983 by—

(a)closing the Bloomsbury and Westminster County Courts (article 2);

(b)establishing a new court called the Central London County Court (articles 3 and 5).

The Central London County Court has jurisdiction in proceedings commenced before the coming into force of this Order in the Bloomsbury or Westminster County Courts. The Central London County Court is designated for the purposes of the Race Relations Act 1976 and the district of the Central London County Court is assigned for admiralty purposes to the Mayor’s and City of London County Court. The Central London County Court is excluded from having insolvency and winding-up jurisdiction.
