Explanatory Note

(This note is not part of the Order)

Article 2 of this Order brings into force on 9th November 1992 the following provisions of the Planning and Compensation Act 1991—

  • section 12(1) (planning obligations), so far as it is not yet in force;

  • section 32 (planning: minor and consequential amendments), in so far as it relates to paragraphs 9(2)(d) (so far as that paragraph is not yet in force), 53(5) (local planning authorities: distribution of functions) (so far as that paragraph is not yet in force), 54(2), (3)(b) and (f) and 57(2)(f) (planning obligations); and

  • section 84(6) (repeals) and Schedule 19 in so far as they relate to repeals in Part I of Schedule 19 specified in the Schedule to this Order.

Article 3 contains a transitional provision.
