The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1), and now vested in him(2), and of all enabling powers:—

1.  From the date on which this Order comes into force—

(a) each length of trunk road described in the Schedule, and shown on the deposited plan by broad striped hatching and a reference letter, shall cease to be a trunk road;

(b) the lengths described in paragraphs 1, 2 and 6 of the Schedule (shown on the deposited plan by, respectively, the reference letters A,B and F) shall be principal roads; and

(c) the length described in paragraph 5 of the Schedule (shown on the deposited plan by the reference letter E) shall be a classified road.

2.  In this Order—

(i) “the deposited plan”	means the plan numbered HA10/2/SWM68 marked “The A38, A40 and A417 Trunk Roads (Gloucester City) (Detrunking) Order 1992” signed by authority of the Secretary of State for Transport and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;
(ii) “principal road”	as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways, classified by the Secretary of State;
(iii) “classified road”	as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads; and
(iv) “the Schedule”	means the Schedule to this Order.

3.  This Order shall come into force on 27th March 1992 and may be cited as the A38, A40 and A417 Trunk Roads (Gloucester City) (Detrunking) Order 1992.

SCHEDULE LENGTHS OF TRUNK ROAD CEASING TO BE TRUNK ROADS

The lengths of trunk road ceasing to be trunk roads in the City of Gloucester in the County of Gloucestershire are as follows:

1.  The A38 Trunk Road (known as Tewkesbury Road), from the northern side of its roundabout junction with the A40 Trunk Road (St. Oswald’s Road and Estcourt Road) northwards to the southern side of the Longford Roundabout.	A	Principal Road
2.  The A40 Trunk Road, from the southern side of Over Roundabout, including the slip road to the westbound carriageway of the A40 Trunk Road (west of that roundabout), southeastwards (along Over Causeway) to and including the Westgate Gyratory, generally northeastwards (along St.Oswald’s Road) to and including its roundabout junction with EstcourtRoad, but excluding the lengths described in paragraphs 3 and 4 below, to and including its roundabout junction with Cheltenham Road. 3.  The A40 Trunk Road, comprising the service road adjacent to part of the northern side of Estcourt Road.	C	—
4.  The A40 Trunk Road, comprising the service road adjacent to part of the southern side of Estcourt Road.	D	—
5.  The A40 Trunk Road (known as Cheltenham Road), from the northeastern side of its roundabout junction with Estcourt Road to the southwestern side of the Elmbridge Court Roundabout.	E	Classified Road
6.  The A417 Trunk Road, from the southeastern side of its roundabout junction with Estcourt Road and Cheltenham Road southwards (along Estcourt Road) to and including its roundabout junction with Barnwood Road, southeastwards (along Barnwood Road) to and including its roundabout junction with Barnwood Bypass (Walls’s Roundabout), then northeastwards (along Barnwood Bypass) to the western side of CEGB Roundabout.
