Enforcement11

Notwithstanding the Health and Safety (Enforcing Authority) Regulations 198918, the enforcing authority for these Regulations shall—

a

insofar as they apply to the carriage of explosives, be the Health and Safety Executive; and

b

insofar as they apply to the carriage of petrol (and that carriage is also carriage which is subject to the provisions of Schedule 4 to the Road Traffic (Carriage of Dangerous Substances in Road Tankers and Tank Containers) Regulations 1992), be the relevant petroleum licensing authority ascertained in accordance with regulation 25(2)(a) of the said Regulations.
