The Right to Purchase (Prescribed Persons) (Scotland) Order 1993

The Secretary of State, in exercise of the powers conferred on him by section 61(11)(w) of the Housing (Scotland) Act 1987(1), and of all other powers enabling him in that behalf, hereby makes the following Order:–

Citation, commencement and revocation

1.—(1) This Order may be cited as the Right to Purchase (Prescribed Persons) (Scotland) Order 1993 and shall come into force on 27th July 1993.

(2) The Right to Purchase (Prescribed Persons) (Scotland) Order 1986(2) is hereby revoked.

Prescribed persons

2.  The persons listed below and any predecessor of any of those persons are hereby prescribed under section 61(11)(w) of the Housing (Scotland) Act 1987–

Explanatory Note

(This note is not part of the Order)

Under the Housing (Scotland) Act 1987 qualification for the right to purchase and entitlement to discount depend inter alia on occupation as a tenant of a house or of a succession of houses provided by the public sector landlords mentioned in section 61(11) of that Act. Paragraph (w) of section 61(11) states that in addition to the persons specifically mentioned in section 61(11) the Secretary of State may prescribe other persons by Order. This Order revokes the previous Order which prescribed “other persons” and prescribes another list of “other persons” which is basically the list in the previous Order with additions and changes bringing that list up to date. As before this Order includes Ministers of the Crown not already mentioned for the specific purposes set out in paragraph (m), (o), (p), (q), (t) or (v) of section 61(11).
