Disclosure of Assessments and Reasons for Decisions17

The Attorney General shall not be required to give reasons for his conclusions under article 14(1), or his decisions under article 15(1) or (4) or under article 16(1) or (4), to the extent that to do so would involve the disclosure of information obtained under the Schedule to this Order contrary to the provisions of that Schedule.

The Attorney General shall not be required to give reasons for his conclusions under article 14(1), or his decisions under article 15(1) or 16(1), to the extent that to do so would in his opinion be likely to cause damage to national security.

Where the Commission has so consented, the Attorney General may—

a

in giving reasons for his decision under article 15(1) disclose extracts from or the entirety of the Commission’s assessment obtained under article 6(3); and

b

in giving reasons for his decision under article 15(4) disclose extracts from or the entirety of the Commission’s assessment obtained under article 8(4).

No assessment obtained from the Commission under article 6(3) shall be disclosed by the Attorney General when notifying a decision under article 15(4).
