The Secretary of State for Transport, in exercise of the powers conferred by section 91(1), (4) and (5) of the Transport Act 1968(1), and now vested in him(2), and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 91(8) of that Act, hereby makes the following Regulations:

1.  These Regulations may be cited as the Goods Vehicles (Operators' Licences) (Temporary Use in Great Britain) (Amendment) (No. 2) Regulations 1993 and shall come into force on 28th September 1993.

2.  The Goods Vehicles (Operators' Licences) (Temporary Use in Great Britain) Regulations 1980(3) shall be amended as follows.

3.  After regulation 6A (Exemption for foreign goods vehicles with Community cabotage authorisations) there shall be inserted the following regulation:—

Exemption for Albanian goods vehicles

6B.(1) In this regulation—

“Albanian goods vehicle” means a foreign goods vehicle which is owned or operated by a person who is authorised under the law of the Republic of Albania to engage in the international carriage of goods by road for hire or reward or on his own account and which, in the case of a motor vehicle, is registered in the Republic of Albania; and

“relevant date” means the date on which the Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Albania on international road transport signed on 9th February 1993(4) comes into force, which date shall be notified in the London Gazette.

(2) On and after the relevant date, section 60(1) of the Act shall not apply to the use in Great Britain of an Albanian goods vehicle for the carriage of any goods.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Goods Vehicles (Operators' Licences) (Temporary Use in Great Britain) Regulations 1980. They modify Part V of the Transport Act 1968 so as to exempt the operator of any Albanian goods vehicle (as defined in the Regulations) from the need to obtain an operator’s licence under section 60(1) of that Act in order to carry goods in Great Britain on an international journey.

The exemption of Albanian goods vehicles gives effect to an Agreement between the United Kingdom and the Republic of Albania on international road transport signed on 9th February 1993 which enters into force on a date to be notified in the London Gazette.
