The Commissioners for Oaths (Authorised Persons) (Fees) Order 1993

The Lord Chancellor, in exercise of the powers conferred on him by section 113 of the Courts and Legal Services Act 1990(1) and with the concurrence of the Lord Chief Justice and the Master of the Rolls, hereby makes the following Order:—

1.—(1) This Order may be cited as the Commissioners for Oaths (Authorised Persons)(Fees) Order 1993 and shall come into force on 18th October 1993.

(2) In this Order “commissioner for oaths” means any authorised person under section 113 of the Courts and Legal Services Act 1990 other than a solicitor to whom the provisions of section 81 of the Solicitors Act 1974(2) apply.

2.  The following fees (inclusive of value added tax where payable) shall be chargedby commissioners for oaths:—

For taking an affidavit, declaration or affirmation, for each person making the same ... ... ... ...5.00
And in addition, for each exhibit therein referred to and required to be marked or for each schedule required to be marked ... ... ... ...2.00

Explanatory Note

(This note is not part of the Order)

This Order prescribes the fees chargeable by authorised persons defined (including barristers) in section 113 of the Courts and Legal Services Act 1990 when acting as commissioners for oaths.The fees are £5 for taking affidavits and similar declarations, and £2 for marking exhibits.
