Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if certain conditions are fulfilled. Regulation 3 of the Local Government Act 1988 (Defined Activities) (Specified Period) (England) Regulations 1988 requires the period included in the specification of work required to be made available in accordance with section 7(2)(b) of the Local Government Act 1988 to be ascertained by reference to those Regulations.
Under those Regulations the Woking Borough Council may not carry out catering work where the period included in the specification is less than a specified period. In these Regulations a shorter period is substituted for the 4 years which would otherwise be the period applicable in respect of catering work carried out for the Woking Borough Council at Woking Leisure Centre, Woking Park, Kingfield Road, Woking.
