The Farm and Conservation Grant (Amendment) Regulations 1993

The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated for the purposes of section 2(2) of the European Communities Act 19721 in relation to the common agricultural policy of the European Economic Community2, acting jointly, in exercise of the powers conferred on them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Title, commencement and interpretation1

These Regulations may be cited as the Farm and Conservation Grant (Amendment) Regulations 1993 and shall come into force on 1st December 1993.

In these Regulations—

a

“the principal Regulations” means the Farm and Conservation Grant Regulations 19913;

b

“the appropriate Minister” has the same meaning as in regulation 2(1) of the principal Regulations.

Savings2

Regulation 5 below shall not apply to—

a

any improvement plan approved under the principal Regulations before 1st December 1993; or

b

any request for the variation of such a plan or any application for approval of an improvement plan received before that date by the appropriate Minister,

and that provision of these Regulations shall not affect the operation of the principal Regulations in relation to any such plan, request or application.

Amendment of the principal Regulations

The principal Regulations shall be further amended in accordance with regulations 4 and 5 below.

In regulation 12 (claims for grant and closing dates for incurring certain expenditure)—

a

in sub-paragraph (c) of paragraph (2), for the date “17th November 1993” there shall be substituted the date “17th November 1994”;

b

in sub-paragraph (c) of paragraph (3), for the date “16th November 1994” there shall be substituted the date “16th November 1995”.

In Schedule 1 (“ELIGIBLE AGRICULTURAL WORKS, FACILITIES AND TRANSACTIONS AND RATES OF GRANT”)—

a

in each of paragraphs 1(a) and (c)(i), 2, 3, and 4, in column 2, for the figure “40” there shall be substituted the figure “25”, and in column 3, for the figure “50” there shall be substituted the figure “30”;

b

in paragraph 1(b), in each of columns 2 and 3, for the figure “50” there shall be substituted the figure “25”;

c

in paragraph 1(c)(ii), in column 3, for the figure “50” there shall be substituted the figure “30”;

d

in paragraph 5, in column 2, for the figure “35” there shall be substituted the figure “20”, and in column 3, for the figure “35” there shall be substituted the figure “25”.

These Regulations amend the Farm and Conservation Grant Regulations 1991, as amended (“the principal Regulations”), which implement provisions in Title IV of Council Regulation (EEC) No.2328/91 (OJ No.L218, 6.8.91, p. 1) on improving the efficiency of agricultural structures.

The Regulations amend the principal Regulations by—

a

changing from 17th November 1993 to 17th November 1994 the closing date by which, for grant to be payable, expenditure must be incurred in respect of certain items which are eligible for grant in the Isles of Scilly (regulation 4(a));

b

changing from 16th November 1994 to 16th November 1995 the closing date by which, for grant to be payable, claims for grant in respect of those items must be received (regulation 4(b));

c

subject to savings provisions, reducing the rates of grant in respect of a number of items (regulations 2 and 5).
