The Secretary of State for Transport, in exercise of his powers under section 73(1)(a), (6)(a) and (9) of the Civil Aviation Act 1982(1) and of all other powers enabling him in that behalf, and with the consent of the Treasury in respect of regulation 2(a), hereby makes the following Regulations:

1.  These Regulations may be cited as the Civil Aviation (Joint Financing) (Fifth Amendment) Regulations 1993 and shall come into force on 1st January 1994.

2.  The Civil Aviation (Joint Financing) Regulations 1988(2) shall be amended as follows:

(a)In regulation 4(1) for the sums £43.65, £10.43 and £33.22 there shall be substituted respectively the sums £43.86, £11.63 and £32.23;

(b)In regulation 15(2) for the figure 2% there shall be substituted the figure 2.234%.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Civil Aviation (Joint Financing) Regulations 1988, as follows—

The charge payable by operators of aircraft to the Civil Aviation Authority in respect of crossings between Europe and North America is increased in consequence of a decision of the Council of the International Civil Aiation Organisation. The element of the charge payable in respect of air navigation services provided by the Government of Denmark is increased from £10.43 to £11.63. The element of the charge payable in respect of air navigation services provided by the Government of Iceland is decreased from £33.22 to £32.23. The total charge is thus increased from £43.65 to £43.86 (regulation 2(a)).

The charges are payable in pursuance of the Agreements on the Joint Financing of certain Air Navigation Services respectively in Greenland and the Faroe Islands and in Iceland, opened for signature in Geneva on 25th September 1956 (Cmnd. Nos 677 and 678) as amended by the Protocols opened for signature at Montreal on 3rd November 1982 (Cmnd. Nos 8844 and 8845).

In consequence of a decision of the Council of the International Civil Aviation Organisation the sum which is to be deducted by the CAA from the charges received and remitted to that Organisation in respect of air navigation services provided by it is increased from 2% to 2.234% (regulation 2(b)).

The charges are required by the principal Regulations to be remitted to the Governments of Denmark and Iceland subject to the deduction of a fee not exceeding 5 per cent for the CAAs expenses in billing and collection.
