The Motor Vehicles (Tests) (Amendment) Regulations 1993

The Secretary of State for Transport, in exercise of the powers conferred by sections 45 and 46 of the Road Traffic Act 1988(1) and the Department of Transport (Fees) Order 1988(2), and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

1.  These Regulations may be cited as the Motor Vehicles (Tests) (Amendment) Regulations 1993 and shall come into force on 2nd January 1994.

2.  The Motor Vehicles (Tests) Regulations 1981(3) shall be further amended in accordance with the provisions of these Regulations.

3.  In the regulations specified in column 1 of the Table below for the amounts specified in column 2 of the Table there shall be substituted the amounts specified in column 3 of the Table.

4.  In regulation 20(4) for the Table there shall be substituted the following Table–

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Motor Vehicles (Tests) Regulations 1981 (“the 1981 Regulations”).

The fees payable for test examinations, other than in the case of Class VI vehicles, are increased as follows–

(a)motor bicycles not having a side car attached, from £10.35 to £10.80;

(b)motor bicycles with a side car attached, from £17.30 to £18.20;

(c)vehicles in Class III (“light motor vehicles” other than motor bicycles), from £20.30 to £21.30;

(d)vehicles in Class IV (“motor cars” and “heavy motor cars” not being vehicles within Classes III, V, VI or VII), from £24.00 to £25.30;

(e)vehicles in Class V (“large passenger–carrying vehicles”, particular public service vehicles and “play buses”), from £30.35 to £32.00; and

(f)vehicles in Class VII (goods vehicles with a design gross weight of more than 3,000 kgs but not more than 3,500 kgs), from £26.50 to £27.94.

In the case of vehicles, other than those in Class VI, the fee payable on an appeal, where a notice of the refusal of a test certificate has been issued, is the same amount as the fee payable under regulation 20(1), while the fee for a duplicate test certificate is one half of this amount. These fees will be increased accordingly.

The fees payable for testing Class VI vehicles (public service vehicles other than those of a type specified in regulation 5(3)) are as follows.

(a)The fee payable for an examination of a vehicle constructed or adapted to carry more than 12 passengers is reduced from £42.70 to £40.30. Where the appointment for such an examination is, at the applicant’s request, on a Saturday, the supplement to the normal fee remains unchanged at £27.50.

(b)The fee payable for a re–examination of such a vehicle within 14 days of the date of the issue of the notice of refusal of a test certificate, is reduced from £21.00 to £19.80. Where the appointment for such a re–examination is, at the applicant’s request, on a Saturday, the supplement to the normal fee remains unchanged at £13.75.

(c)The fee payable for the re–examination of such a vehicle later than 14 days from the issue of the notice of refusal is reduced from £42.70 to £40.30. Where the appointment for such a re–examination is, at the applicant’s request, on a Saturday, the supplement to the normal fee remains unchanged at £27.50.

(d)The fee payable for an examination of a vehicle in any other case is reduced from £29.80 to £28.20. Where the appointment for such an examination is, at the applicant’s request, on a Saturday, the supplent to the normal fee remains unchanged at £20.00.

(e)The fee payable for a re–examination of such a vehicle within 14 days of the date of the issue of the notice of the refusal of a test certificate, is reduced from £14.90 to £14.10. Where the appointment for such a re–examination is, at the applicant’s request, on a Saturday, the supplement to the normal fee remains unchanged at £10.00.

(f)The fee payable for a re–examination of such a vehicle later than 14 days from the issue of the notice of refusal is reduced from £29.80 to £28.20. Where the appointment for such a re–examination is, at the applicant’s request, on a Saturday, the supplement to the normal fee remains unchanged at £20.00.

In the case of Class VI vehicles, the fee payable on an appeal, where a notice of the refusal of a test certificate has been issued, is the same amount as the fee payable under regulation 20(1). This fee will be reduced accordingly. The fee payable for the issue of a duplicate test certificate for a Class VI vehicle is reduced from £9.30 to £8.80.

The fee payable for the supply of 100 forms of test certificate is reduced from £36.00 to £27.00.
