The Goods Vehicles (Plating and Testing) (Amendment) (No. 2) Regulations 1993

Coming into force

The Secretary of State for Transport, in exercise of the powers conferred by sections 49 and 51(1) of the Road Traffic Act 19881 and the Department of Transport (Fees) Order 19882, and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Goods Vehicles (Plating and Testing) (Amendment) (No. 2) Regulations 1993 and shall come into force on 2nd January 1994.

Preliminary2

The Goods Vehicles (Plating and Testing) Regulations 19883 shall be further amended in accordance with the provisions of these Regulations.

Amendment to regulation 3 (Interpretation)3

In regulation 3(3), for “1.02” there shall be substituted “0.5”.

Amendments relating to fees

Regulation 12 shall be amended as follows.

In paragraph (3) for the words “a fee” to the end of the paragraph, there shall be substituted the words “the fee determined in accordance with the Table below by reference to the description of vehicle.”.

After paragraph (3) as so amended there shall be inserted the following Table–

Regulation 16 shall be amended as follows.

In paragraph (1), for “£17.60” there shall be substituted “£16.60” and for “£9.70” there shall be substituted “£8.30”.

For paragraph (2) there shall be substituted the following paragraph–

Subject to paragraphs (3) and (5), in circumstances other than those described in paragraph (1), the fee for a re–test under regulation 15 shall be the fee determined in accordance with the Table in regulation 12 by reference to the description of vehicle.

In paragraph (3), for “£17.60” there shall be substituted “£16.60” and for “£9.70” there shall be substituted “£8.30”.

In paragraph (6)(a), for the words “on the first day” there shall be substituted the words “or on the first day”.

Regulation 34 shall be amended as follows.

These Regulations amend the Goods Vehicles (Plating and Testing) Regulations 1988 (“the 1988 Regulations”) as follows–

The fee payable on an application for a first examination or periodical test undergoes the changes shown in the Table below.

The fee for a re–test or a further re–test within fourteen days after the examination or earlier re–test is reduced from £17.60 to £16.60 in the case of a motor vehicle and from £9.70 to £8.30 in the case of a trailer. The fee for re–tests in other circumstances undergoes the changes shown in the Table below.

The fee payable on a request for an amendment to a plating certificate following a notifiable alteration or for a re–examination where a particular in the certificate is or may be no longer applicable is reduced from £13.90 to £13.50.

As can be seen from the Table, the amendments introduce different fees for vehicle tests according to the number of axles.

Regulation 3(3) of the 1988 Regulations provided that in counting the number of axles of a vehicle, where the centres of the areas of contact between all the wheels and the road surface can be included between any two vertical planes at right angles to the longitudinal axis of the vehicle less than 1.02 metres apart, those wheels are to be treated as constituting one axle. These Regulations amend regulation 3(3) by reducing the relevant distance to 0.5 metres.

The opportunity has also been taken to make some drafting amendments to regulation 16 of the 1988 Regulations.
