The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by section 1(1) and (2) of the Bees Act 1980(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1.  This Order, which implements the parts relating to bees of Council Directive 92/65/EEC (laying down animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A(I) to Directive 90/425/EEC)(2), may be cited as the Importation of Bees (Amendment) Order 1993 and shall come into force on 1st January 1994.

Amendment to the Importation of Bees Order 1980

2.—(1) In article 3 of the Importation of Bees Order 1980(3), for the words “Articles 4 and 5 below” there shall be substituted the words “Articles 3A, 4 and 5 below”.

(2) After article 3 of that Order there shall be added the following provision:

Importation of bees from another member State

3A.(1) Subject to the following provisions of this article, Article 3 above shall not apply to the importation by way of trade from another member State of bees of the species Apis melifera.

(2) Any such importation must be in conformity with the provisions of Article 8 of Council Directive 92/65/EEC (laying down animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A(I) to Directive 90/425/EEC) in addition to the requirements of the Animals and Animal Products (Import and Export) Regulations 1993(4).

(3) This exemption from Article 3 above shall only apply in an area which has been declared, under Article 8 of the Bee Diseases Control Order 1982(5), to be an area in which the presence of varroasis has been confirmed, and is accordingly an infected area; and for the avoidance of doubt it is declared that Article 3 above shall continue to apply in any area which has not been declared to be an infected area..

Explanatory Note

(This note is not part of the Order)

This Order implements the provisions relating to bees of Council Directive 92/65/EEC laying down animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to animal health requirements laid down in specific Community rules referred to in Annex A(I) to Directive 90/425/EEC.

Under Article 8 of that directive any bee imported from another member State must be accompanied by the correct health certificate.

In accordance with Article 15 of that directive, the permitted importation of bees from other member States without a licence is confined to those parts of Great Britain which have been designated an infected area as provided for in the Bee Disease Control Order 1982.
