The General Optical Council (Registration and Enrolment (Amendment) Rules) Order of Council 1993

At the Council Chamber, Whitehall, the 26th day of February 1993

By the Lords of Her Majesty’s Most Honourable Privy Council

Whereas in pursuance of section 10 of the Opticians Act 19891 the General Optical Council have made the Registration and Enrolment (Amendment) Rules 1993 as set out in Schedule 1 to this Order:

And Whereas by section 34 of the said Act such rules shall not come into force until approved by Order of the Privy Council:

And Whereas upon rule 3 of the said rules coming into force the revocations mentioned therein shall render wholly spent the Orders of Council set out in Schedule 2 to this Order:

Now, therefore, Their Lordships, having taken the said rules into consideration, are hereby pleased to approve the same, and hereby revoke with effect from 1st April 1993 the Orders of Council set out in column 1 of Schedule 2 to this Order (the references to which are given in column 2 of that Schedule).

This Order may be cited as the General Optical Council (Registration and Enrolment (Amendment) Rules) Order of Council 1993.

SCHEDULETHE REGISTRATION AND ENROLMENT (AMENDMENT) RULES 1993

In pursuance of their powers under section 10 of the Opticians Act 1989, the General Optical Council hereby made the following Rules:—

These Rules may be cited as the Registrationand Enrolment (Amendment) Rules 1993.

In the Registration and Enrolment Rules 1976 (which in their original form are scheduled to the General Optical Council (Registrationand Enrolment Rules) Order of Council 19772) the Appendix shall be amended by replacing the figures £40, £23and £14 on each occasion where they appear by the figures £45, £26and £16 respectively.

The whole of the following Rules (which are already spent, or will be spent on the coming into force of these Rules) are hereby revoked—

  • The Registration and Enrolment (Amendment) Rules 19803,

  • The Registration and Enrolment (Amendment) Rules 19814,

  • The Registration and Enrolment (Amendment) Rules 19825,

  • The Registration and Enrolment (Amendment) Rules 19876,

  • The Registration and Enrolment (Amendment) Rules 19907, and

  • The Registration and Enrolment (Amendment No. 2) Rules 19908.

Rule 2(8) of the Registrationand Enrolment (Amendment) Rules 19799 and Rule 2(iii) of the Registration and Enrolment (Amendment) Rules 198510 (which are also spent) are hereby also revoked.

These Rules shall come into force on 1st April 1993and shall apply to applications for registration, enrolment, retention, restorationand transfer to take effect on or after 1st April 1993 whether made before, on or after that date.

The Rules approved by this Order increase with effect from 1st April 1993 the fees payable to the General Optical Council by ophthalmic and dispensing opticians and bodies corporate carrying on business as opticians for registration, enrolment or retention, restoration to and transfer within the register of opticians. The fees were last fixed in April 1991 and the order of increase is approximately 13 per cent. They also revoke previous Rules effecting fee increases which are now spent.

This Order also revokes previous Orders of Council which became spent on the revocation of Rules which are scheduled to them.
