The Local Government Finance Act 1992 (Commencement No.8 and Transitional Provisions) Order 1993

The Secretary of State, in exercise of the powers conferred on him by sections 113(2) and 119(2) of the Local Government Finance Act 1992((1)) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Local Government Finance Act 1992 (Commencement No.8 and Transitional Provisions) Order 1993.

(2) In this Order, “the Act” means the Local Government Finance Act 1992.

Commencement of provisions

2.  The following provisions of the Act shall, so far as not then in force, come into force on 1st April 1993—

(a)sections 99(2) and 111;

(b)in Schedule 11, paragraphs 29(a), 30, 32 to 36 and 38(b) and (e);

(c)in Schedule 13, paragraphs 2, 9, 35, 37(2), 38, 40, 44(a), (b) and (d), 53 to 56 and 93; and

(d)in Schedule 14, the repeals listed in the Schedule to this Order.

Transitional provisions

3.  The repeal by this Order of section 28B of the Registration of Births, Deaths and Marriages (Scotland) Act 1965((2)) shall not affect the operation of that section, or of regulations made under it, in relation to any death occurring before 1st April 1993.

4.  The repeal by this Order of subsection (2A) of section 18 of the Abolition of Domestic Rates Etc. (Scotland) Act 1987((3)) shall not affect the operation of that subsection in relation to any death occurring before 1st April 1993.

5.  Nothing in this Order shall affect the operation of—

(a)sections 110 and 118(1)(b) of the Local Government (Scotland) Act 1973((4)); and

(b)Schedule 5 to the Abolition of Domestic Rates Etc. (Scotland) Act 1987;

in relation to any financial year beginning before 1st April 1993.

Explanatory Note

(This note is not part of the Order)

This Order provides for the commencement on 1st April 1993 of certain provisions of the Local Government Finance Act 1992 relating to Scotland. The provisions in question are listed in article 2 of the Order. Articles 3 to 5 contain transitional provisions in connection with the repeals of certain enactments being brought into force by this Order.
