NURSES, MIDWIVES AND HEALTH VISITORS

The Nurses, Midwives and Health Visitors Act 1992 (Commencement No. 1) Order 1993

In exercise of powers conferred upon me by section 17(3) of the Nurses, Midwives and Health Visitors Act 19921 and of all other powers enabling me in that behalf, I hereby make the following Order:—

Citation and interpretation1

This Order may be cited as the Nurses, Midwives and Health Visitors Act 1992 (Commencement No. 1) Order 1993.

In this Order—

  • “the 1979 Act” means the Nurses, Midwives and Health Visitors Act 19792;

  • “the 1992 Act” means the Nurses, Midwives and Health Visitors Act 1992.

Appointed Day2

1st April 1993 is the day appointed for the coming into force of the whole of the 1992 Act so far as it is not already in force3, except for the following purposes—

a

effecting the substitution, by section 4 of the 1992 Act, of section 5(8) of the 1979 Act so far as that substitution consists of the addition of a new paragraph (e);

b

effecting the substitution, by section 4 of the 1992 Act, of section 5(9) of the 1979 Act so far as that substitution consists of the removal of that provision in its application to paragraph 7 of Schedule 2 to that Act;

c

bringing into force in Northern Ireland subsection (2) of section 5 of the 1992 Act and section 17(4) of the 1992 Act in its application to that provision; and

d

effecting the repeal, by section 16(2) of, and Schedule 3 to, the 1992 Act, of paragraph 7 of Schedule 2 to the 1979 Act.

(This note is not part of the Order)

This Order brings into force on 1st April 1993 all the provisions of the Nurses, Midwives and Health Visitors Act 1992 which did not come into force on Royal Assent, except section 5(2) in respect of Northern Ireland, and section 4 in so far as it relates to the new section 5(8)(e) of the Nurses, Midwives and Health Visitors Act 1979. Paragraph 7 of the existing Schedule 2 to the 1979 Act is also preserved.
