The Adoption (Designation of Overseas Adoptions) (Variation) Order 1993

The Secretary of State, in exercise of the powers conferred upon her by sections 67(4) and 72(2) of the Adoption Act 1976(1) and of all other powers enabling her in that behalf hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the Adoption (Designation of Overseas Adoptions) (Variation) Order 1993 and shall come into force on 5th April 1993.

Variation of Adoption (Designation of Overseas Adoptions) Order 1973

2.  The Adoption (Designation of Overseas Adoptions) Order 1973(2) (designation) shall be varied as follows—

(a)there shall be inserted at the beginning of paragraph (2) of Article 3 the words “Subject to paragraph (2A) of this Article,”;

(b)after paragraph (2) of Article 3 there shall be inserted the following paragraph—

(2A) This Article also applies, as respects any adoption effected on or after 5th April 1993, in relation to any place which, at the time the adoption is effected, forms part of the People’s Republic of China.

Explanatory Note

(This note is not part of the Order)

This Order includes China among those countries whose adoptions are designated in the Adoption (Designation of Overseas Adoptions) Order 1973, and whose adoption orders are therefore to be recognised in England and Wales.
