In exercise of the powers conferred on the Secretary of State by section 8(5) and (7) of the Education Act 19801 the Secretary of State for Wales hereby makes the following Regulations:–

Citation, commencement and application1

These Regulations may be cited as the Education (School Curriculum and Related Information) (Amendment) (Wales) Regulations 1993 and shall come into force on 6th May 1993.

These Regulations apply in Wales only.

Amendment of the Education (School Curriculum and Related Information) (Wales) Regulations 19912

The Education (School Curriculum and Related Information) (Wales) Regulations 19912 are hereby amended as follows:–

In regulation 5(2) for the words “subsection (9) of section 8 of the Act of 1980” there shall be substituted the words “subsection (1) of section 8 of the Act of 1980”.

In regulation 5 at the end there shall be added the following paragraph:–

Without prejudice to the foregoing provisions of this regulation, such particulars of the arrangements made by the relevant education authority under subsection (1) of section 7 of the Act of 1980 (appeals against admission decision) and mentioned in subsection (1)(c) of section 8 of that Act shall also be published by being set out in any document containing a notification to parents of a decision referred to in subsection (1) of section 7 of that Act refusing their child admission to a school for which such parents have expressed a preference in accordance with arrangements made under subsection (1) of section 6 of that Act.

In regulation 7 at the end there shall be added the following paragraph:–

Without prejudice to the foregoing provisions of this regulation, such particulars of the arrangements made under subsection (2) of section 7 by the governors of an aided or special agreement school (appeals against admission decisions) and mentioned in subsection (2)(b) of section 8 of the Act of 1980 shall also be published by being set out in any document containing a notification to parents of a decision referred to in subsection (2) of section 7 of that Act refusing their child admission to a school for which such parents have expressed a preference in accordance with arrangements made under subsection (1) of section 6 of that Act.

These Regulations amend the Education (School Curriculum and Related Information) (Wales) Regulations 1991 (S.I.1991/1658). The amendment Regulations correct an error in the main Regulations (regulation 2(1) of the amendment Regulations). They also require parents to be informed of the arrangements for appealing against a decision refusing a child admission to a school other than an aided or special agreement school (regulation 2(2)) and for similar information in similar circumstances to be given in the case of an aided or special agreement school (regulation 2(3)).
