For the purposes of determining whether section 5(3C) or (3D) of the Lotteries and Amusements Act 1976(1) (“the 1976 Act”) (which was inserted by section 48(3) of the Act) applies to a lottery, any earlier lottery (within the meaning of section 5 of the 1976 Act) shall be disregarded if the date of the lottery fell before 3rd May 1994.
