2. In regulation 4(1) of the Environmental Protection (Applications, Appeals and Registers) Regulations 1991(1), after sub-paragraph (h) there shall be inserted the following sub-paragraph—
“(i)the islands or district council in whose area the process will be carried on, in the case of all prescribed processes designated for central control which will be carried on in Scotland in respect of which the enforcing authority is under a duty, by virtue of paragraph 2(1) of Schedule 4 to the Waste Management Licensing Regulations 1994(2), to discharge its functions under Part I of the 1990 Act with the objective of ensuring that waste is recovered or disposed of without causing nuisance through noise.”.
