The Railways Act 1993 (Commencement No. 5 and Transitional Provisions) Order 1994

The Secretary of State, in exercise of the powers conferred on him by sections 143(3) and 154(2) of the Railways Act 1993(1), hereby makes the following Order:—

Citation

1.  This Order may be cited as the Railways Act 1993 (Commencement No. 5 and Transitional Provisions) Order1994.

Provisions coming into force

2.  Subject to article 3 below, the following provisions of the Railways Act 1993 shall come into force on 15th July 1994:

Transitional provisions

3.—(1) The repeal of section 8 of the Railways Act 1974 shall not affect the operation of that section in relation to any application for grant made pursuant to that section before 15th July 1994 but in respect of which no decision has been made by the Secretary of State before that date.

(2) The repeal of section 36 of the Transport Act 1981 shall not affect the operation of that section in relation to any application for grant made pursuant to that section before 15th July 1994 but in respect of which no decision has been made by the Secretary of State before that date.

Explanatory Note

(This note is not part of the Order)

This Order brings into force, on 15th July 1994, sections 139 and 140 of the RailwaysAct 1993 which relate to the making of grants to assist the provision of facilities for freight haulage by railway and inland waterway, and related repeals in Schedule 14. Article 3 of the Order makes transitional provisions.
